Frank Aquila Talks to Asia Law Portal About 2019 Challenges and Opportunities for Japanese Investors in the United States

Frank Aquila, a senior partner in Sullivan & Cromwell’s Mergers & Acquisitions Group, spoke to Asia Law Portal about the uptick in Japanese companies seeking acquisitions in the United States—and what opportunities and challenges Japanese investors could face in 2019—in a December 19 article titled “The 2019 US landscape for Japan’s corporate investors: An interview with Frank Aquila, Partner, Sullivan & Cromwell.” Frank spoke about factors that inbound investors in the United States will need to consider, such as the newly enacted Foreign Investment Risk Review Modernization Act of 2018, or FIRRMA, which expands CFIUS’s jurisdiction over foreign investment in U.S. business. “Like any potential investor, doing extensive and thorough due diligence from the outset is essential,” Frank said of Japanese investors considering U.S. M&A targets. “The most important step is selecting financial and legal advisors with substantial cross-border acquisition experience and a knowledge of the sector in which the potential buyer operates.”
